The use of the electronic services of www.themisjewellery.com presupposes the unconditional agreement to the following terms of use. Therefore, the User must read these terms carefully before using the services of the present website and must responsibly refrain from visiting and using the website, as well as from any transaction or use of the services of the Online Store, in case of disagreement. The aforementioned Company reserves the right to modify and revise the terms and conditions of use and purchase regarding the Online Store freely, whenever deemed necessary. It assumes the responsibility to inform consumers of any change through the present page, while the User is requested to regularly check the content of the terms of use for possible changes. The continuance of navigation within www.themisjewellery.com, even after possible changes, is presumed as an unconditional acceptance of these terms by the User. Contracts through the Online Store are drawn up in the Greek language.

COPYRIGHTS & TRADEMARK

All content included in or made available through this website, such as badges, texts, graphics, logos, button icons, images, photos, drawings etc., forms part of the intellectual property of the Company or its content suppliers and is protected by Greek, European and International Copyright Laws. The Company is licensed by its third-party content suppliers to use relevant content for the operation of the Online Store and its own needs exclusively. Any copy, transfer or derivative work creation based on this content or mislead of the public about the actual provider of the Online Store is forbidden. Reproduction, republishing, uploading, announcement, dissemination, transmission or any other use of the content, in any way or medium, for commercial or other purposes is permitted only with the prior written consent of the Company or any other copyright holder. The names, images, logos and insignia displayed in the Online Store under the THEMIS JEWELLERY brand or the products and services of the Company or third parties, are assets belonging to the Company and protected by all relevant trademark laws. Their inclusion in the Online Store in no case provides permission or right to use them by third parties. 

PRIVACY & PERSONAL DATA PROTECTION         

In order for any transaction through the Online Store www.themisjewellery.com to be carried out and for any orders on the Company’s products to be placed, the disclosure of some personal data regarding the Customer will be requested. Specifically, the following data will be requested: name, shipping address of the products, billing address of the order (in case it is different from the shipping address), contact telephone number, e-mail.

Are the Users’ personal data disclosed to third parties?   
In compliance with article 7A par. 1 (b) Law 2472/1997, these data are processed by the Company in order to implement the order given by the Customer only and in no way will be disclosed, made public or sold to third parties, except in case:
the procedure for the removal of confidentiality is initiated, as defined by Law 2225/1994, any obligations arising from the application of Directive 24/2006 be implemented or, the Company founds itself obliged by law to do so.

Why does the User provide personal information?


This website makes use of the information the User provides during electronic submissions of forms, in order to contact him regarding:
(1) the delivery of the order at his place,
(2) to identify the Customer if deemed necessary,

Personal data retention period

Personal data are stored for as long required for the execution of the contractual relationship between the Company and the User, but also after its expiration. The criterion determining the personal data’s storage period of time is the need to safeguard both the Users’ and the Company’s interests. Specifically, personal information is stored for twenty years counting by the end of the contractual relationship, it is to say twenty years after the Users’ last transaction. However, in case of claims raised by either side, personal information will be stored until the irrevocable resolution of these claims.

Rights of the personal data Subject

The owner of the personal data retains all the rights provided by the applicable provisions on the protection of an individual from the processing of personal data.
The User specifically retains the following rights, the exercise of which is subjected to the individual terms and conditions provided by all applicable provisions.

Right to:
correct inaccurate data concerning him,
request the deletion of data concerning him (right to oblivion),
ensure the restriction of the processing of his personal data,
be informed on the correction, deletion or restriction of the processing of his data,

Denouncement

In case of consideration that the processing of an individual’s personal data is in violation of the above provisions concerning personal data protection, the subject has the right to file a complaint to the Personal Data Protection Authority (1-3 Kifissias Ave., Athens, 11523, tel. 2106475600, fax: 2106475628).

This web page is bound to the accuracy, truthfulness and completeness of the information provided in the Online Store, in terms of the identity of www.themisjewellery.com and the transactions provided through the Online Store. In the context of good faith, the Company is not responsible and therefore not bound by electronic data entries made by mistake or inadvertence according to common experience and is entitled to correct by the moment of their notice. The Company makes every possible effort to provide all the required information for each product (technical characteristics, prices, etc.). However, in cases where the prices or any other product feature seems to extend beyond the usual and reasonable, it is recommended that the User contacts the Company before the completion of the purchase in order to reduce latent errors. 

As far as transactions from the Online Store are concerned, www.themisjewellery.com is not responsible and is not liable for any damage or loss arising from the cancellation of orders, non-execution or delay in execution due to any reason. It does not guarantee the availability of the products displayed in the Online Store, but informs the Customer based on the observed availability/unavailability data about the product. It undertakes the obligation to inform Customers in time regarding unavailability in case of change of the aforementioned data, bearing no further responsibility. In no case is www.themisjewellery.com civilly or criminally liable for any damage (positive, special or negative, which indicatively and not restrictively, divisively or cumulatively consists in loss of profits, data, monetary compensation, etc.) recurring to any Visitor of the Online Store or any third party, due to the operation or not and/or the use of the website and/or the inability to provide services and/or products and/or the information available to the User and/or any unauthorized interference by third parties with products and/or services and/or information available through it.

In case the purchase is completed through the deposit of a monetary sum, but the Company is unable to proceed with the sale due to lack of availability in the selected item, then the Company is obliged to inform the Customer immediately and return the amount paid to a bank account, inside or outside Greece, indicated by the Customer, as long as the depositor is included therein as a beneficiary.

Users’ liability

The User/Customer agrees and undertakes to use the services, information and data of the Online Store as provided by law and based on the rules of good faith and business ethics. He is obliged not to use the Online Store under the brand THEMIS JEWELLERY to:
send, publish, e-mail or otherwise transmit any content that is unlawful for any reason, causes unlawful infringement and damage to the Company or to any third party or violates the confidentiality or the privacy principles related to data of any individual or entity,
send, publish, e-mail or transmit in other ways any content that offends morals regarding use, honest commercial practices, social values, minority, etc.,
send, publish, e-mail or otherwise transmit any content regarding which Users do not have the right to transmit in accordance with the law or applicable contracts (e.g. insider information, proprietary and confidential information obtained or disclosed as part of work relationships or covered by confidentiality agreements),
send, publish, e-mail or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other party proprietary right of any kind that correspond either to the Company or to third parties,
send, publish, e-mail or otherwise transmit any material that contains software viruses or any other code, files, or programs designed to interrupt, damage, corrupt, or equip any software or computer hardware,
intentionally or unintentionally violate applicable laws or regulations,
harass third parties by any means,
collect or save personal data related to other Users.

The links that included in the Online Store lead to pages of the store and, in some cases, they lead the User to websites of third-party providers, companies, etc. These related websites are not under the control of the Company; therefore, the Company bears no responsibility for their content, included links, changes or updates, etc. The Company is not responsible for internet broadcasts or any form of transmission received from any linked website. The Company only provides these links through its Online Store to facilitate its’ use. The use of such links is not mandatory for the Visitor/Customer and the fact that they are included in the Online Store does not imply that the Company approves or accepts their content.

ORDERS & CONSUMER PROTECTION

Each order through the Online Store www.themisjewellery.com constitutes the conclusion of a distance selling contract, as regulated by the legal framework in force: Law 2251/1994, the adaptation of Greek legislation to the 2011/83/EU Directive of the European Parliament and of the Council (25 October 2011) on consumer rights, the amendment on the 93/13/EEC Councils’ Directive and the 1999/44/EC European Parliament and Councils’ Directive.
The User has the right to conclude a valid order through the Online Store, under the condition that he is legally competent to do so in compliance with the provisions of the Civil Code (completion of 18 years of age and non-performance in legal assistance regarding the conclusion of a sales contracts). Orders can also be placed by legal representatives of legal entities.

ORDERS THROUGH THE ONLINE STORE

Order Conditions

In order to place an order in the www.themisjewellery.com Online Store, the Customer is required to fill in a special form including all the necessary data related to the contract and to unconditionally accept the terms of this contract, as well as the terms of use and, in particular, the aforementioned section referring to the collection and use of personal data.
On all the pages of the www.themisjewellery.com Online Store and next to each product available for purchase, there is the indication “Add to Cart”. The customer may select the products he wishes to purchase and then press the “Shopping Cart” button at the right top of the screen. 

Ordering Procedure  

The order is completed through 4 successive steps:
1.Select the product you are interested in by pressing the “Add to cart” option. In the icon that appears, select “View Cart”, if you have completed your purchases, or “Continue Shopping”, if you want to buy more products.
2. On the page that will appear, if you are a new User, you will have to fill in the “Register” field and then choose the “Create Account” option, if you are an old User, you will only have to enter your User name and password in the “Login” field and then select “Login”, otherwise, you can continue as a guest.
In the new options that will appear, select the shipping method and the payment method through which you wish to proceed.
4. To complete the order you must agree to the terms of use and then select the “Confirm order” option.


Payment methods

During step 3 of the aforementioned procedure, the following payment options are offered to the Customer:

a) By deposit to a bank account corresponding to the Company.
The available accounts will appear once the Customer choses this payment option. In this case, the order will be on hold until the bank confirms that the amount has been deposited. Usually, the waiting time for receiving confirmation is up to 2 working days. To facilitate the process, the Company kindly requests the Customer to send a copy of the deposit along with the order number and his name to info@themisjewellery.com. Alternatively, the Customer can send the date, bank, and reason for deposit, along with the order number, his name and a phone number to the above email address belonging to the Company. In case of lack of deposit within 2 working days, the relevant order will be canceled.
b) through PayPal, 
c) by credit or debit card.

In the event of any pending issue in the Customers’ order, the Company will contact him at the details provided through it.

If and only if the Customer does not receive a confirmation e-mail or phone call on the order, he shall inform the Company with no delay, as there may be a problem with the contact details provided. The Company does not bear any responsibility concerning incorrect data registration by the Customer or the subsequent inability of communication.


Order Confirmation & Relevant Updates


The consumer, before completing his order, is informed by the Company’s website about the identity and address of the supplier, the essential characteristics of the product, the price, the quantity, the shipping costs, the method of payment and delivery, along with the validity period. Upon sending the order form, the consumer electronically receives a copy of the order at the email address he provided when placing his order, including a detailed description of the products and a unique code, which enables him to follow the order’s progress and development upon the condition that he is registered as a member.

7. SHIPMENT

Deliveries of products are made within Greece through a cooperating transport Company (and its partners) or a cooperating courier Company, but also worldwide using the relevant services. Shipping costs are calculated according to the postal code (ZIP) of the shipment area or destination country.

Order cancellation due to Customers’ regret

 An order cancellation due to a Customers’ regret is only accepted if the item has not yet been invoiced and given for shipment by the Company. Cancellation is made by sending an e-mail to info@themisjewellery.com or by phone to www.themisjewellery.com on behalf of the Customer, at +302103225863. The Customer must state the exact details of his order.

In case the Customer has paid the value of his approved order before the cancellation statement and the Company has already received it, then the Company must return the value received to the Customer within fourteen (14) calendar days in the exact same way that the payment was expedited (by reversing the amount in a bank account, by paying cash, etc.), minus the additional costs (such as transport costs, etc.). In case a payment order has been given by the Customer, but the money has not yet been received by www.themisjewellery.com (e.g. in the case of a credit card order, where the Bank has not yet deposited the amount), the Company is required to expedite any necessary action and statement to any competent service (Bank, etc.) to notify of the cancellation of the order and to request the refund of any amount owed to the Customer within the period of fourteen (14) working days. Under such circumstance www.themisjewellery.com is considered to have legally fulfilled its obligations, whereas the retraction of any charge will be made based on the terms of the contract that connects the Customer with the third party/service (Bank, etc.) and, therefore,  www.themisjewellery.com holds no responsibility regarding the return time or reimbursement of any related charges.

In any case of withdrawal from the contract of sale, the Customer is charged with the costs of shipping, receipt and cash on delivery (COD), as well as any bank charges.

The Company hereby explicitly states that once the Customer wishes to withdraw from a contract regarding a received product and in order for the return to be valid, both the product and its packaging should be intact (not subjected to any kind of use) and in excellent condition. The deadline for the declaration of unjustified withdrawal is fourteen (14) calendar days, pursuant to the relevant law.

Transportation of returned products          

On the assumption that the Customer wishes to return the purchased products due to a change of mind, he will be charged with the immediate cost of their return. The return of such products can only be realized from the shipment address provided in written form by the Customer at the realization of the sale contract. The Customer therein agrees to allow the carrier all the products he wishes to return, including all their parts and components. Upon receipt of the returned products by the carrier, the Customer will have to sign a receipt form to certify that the delivery to the carrier has taken place. The receipt form will be given to the Customer by the cooperating carrier/courier. If the Customers’ personal presence is impossible at the receival of the products from his premises, he can appoint an adult representative who is considered capable of supervising their receipt, to stand in charge on his behalf.

Exceptions to the right to withdraw

The right of withdrawal does not apply in the following cases:
1.the supply of goods or services whose price depends on financial market fluctuations that cannot be controlled and that may occur within the withdrawal period,
2. the supply of items manufactured with specifications set by the Customer as a consumer or the supply of clearly personalized products,
3. the supply of products which are inextricably mixed with other elements after delivery, due to their nature.            


CONSUMER DISPUTE E-RESOLUTION


Pursuant to Directive 2013/11/EC, which has been incorporated in Greek legislation through the 70330/2015 JMD, electronic settlement regarding consumer disputes following the Alternative Dispute Resolution procedure is a possibility provided throughout the European Union.

Upon the emergence of Customer problems related to a purchase made via the Online Store, the website https://webgate.ec.europa.eu/odr/main can be used as a point of reference in order to achieve the extrajudicial settlement of the dispute, a website directly linked to the pertinent Independent Authority “Consumer Ombudsman” (www.synigoroskatanaloti.gr). 

The present website and the sole proprietorship ASIMINA KON. VOUTSA recognizes, in the context of good faith, the advisory nature of the decisions of the Authority to be addressed, but do not find themselves committed to the enforceability of these decisions. In the event that no compromise or extrajudicial settlement of the dispute is reached, the Courts of Athens hold exclusive jurisdiction upon the matter and Greek Law is applied and prevails.
